Mihaela Maxim, Managing Associate, is a pleading lawyer with extensive experience in a wide range of litigation matters including intellectual property, commercial, real estate, labor and contentious-administrative. She is highly analytical and results oriented, focused on understanding the needs and challenges of the clients she represents.

Passionate about intellectual property law, Mihaela is always seeking for creative and practical solutions, providing not only legal assistance in court disputes, but also sustainable strategies to reduce future potential risks. She has an impressive background in IP related litigation matters, covering copyright, patent, design and trademark enforcement, counterfeiting claims and unlawful competition cases.

Mihaela has coordinated numerous disputes representing bank institutions in litigation cases on the absolute nullity of allegedly abusive clauses in the credit agreements with retail clients and challenging of various sanctions applied by the inspectors of the National Authority for Consumers’ Protection. 

As far as labour law is concerned, Mihaela has assisted both employers and employees in labour disputes concerning the conclusion, execution, modification, and termination of individual contracts or, as the case may be, in disputes concerning the legal relationship between employers and trade unions.

In addition, Mihaela was involved in complex domestic and international arbitral proceedings.

She is a regular speaker on national events focusing on IP disputes and other litigation matters, and also a regular contributor to local and international legal publications.

  • Assisting and representing a leading robotic process automation company in a complex litigation concerning an alleged unauthorised use of software and software architecture without the consent of the copyright holder.
  • Advising and representing a client in a dispute regarding claims amounting to EUR 6,000,000 in relation to software licencing.
  • Advising and representing a client in disputes regarding the alleged infringement of the intellectual property rights of the claimant over some computer embedded software applications.
  • Coordinating activities and representing a leading company active in the steel industry in a dispute concerning the cancellation of a patent granted in the field of metallurgy, in which obtained rejection of a claim for damages in excess of USD 100,000,000.
