1. What is the structure of Romanian Courts?

 

The Romanian judiciary system consists of four levels of courts: local courts, tribunals, courts of appeal and the High Court of Cassation and Justice, which is Romania’s Supreme Court.

 

2. Which rules of jurisdiction govern the creditor & debtor disputes?

 

As a general rule, a debt recovery claim will be issued in the court holding jurisdiction over the respondent’s business headquarters or domicile.1 In terms of material jurisdiction, claims may be issued in first instance in the local courts or tribunals,
depending on the value of the claim. The current threshold is set at approximately EUR 42,000, with no distinction being made between civil and commercial matters.2
